About these Terms and Conditions
In these Terms and Conditions "we" and "us" mean Earth de Fleur Homewares ABN: 39 258 611 654 of PO Box 708, Rochedale, QLD, Australia, and "you" and "your" means you the customer.
These Terms and Conditions together with your order constitute the entire Contract between us and you for the supply of Products. No other Terms and Conditions will apply. The Contract cannot be varied unless we agree to vary it in writing or by email prior to the event.
Legal Capacity to Transact
If you are under the age eighteen (18) years you can not place orders with Earth de Fleur Homewares through this website. By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years. Any orders placed and accepted by us will be deemed to be by persons over the age of eighteen (18) years.
Should Earth de Fleur Homewares suffer any damage or other losses as a result of a transaction entered into by a minor Earth de Fleur Homewares reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with Earth de Fleur Homewares.
Placing Your Order
You may place your order by using our shopping cart on this website, by contacting sales@earthhomewares.com.au phone - 0401 224 310 or visit us at the Southbank Lifestyle Markets in Brisbane.
When you place your order, we will issue you with an order number.
By placing an order, you make an offer to us to purchase the products you have selected based on these Terms and Conditions.
We will confirm acceptance of your order when we send you an email confirming shipment of the goods you have ordered.
If we cannot process or accept your order after payment is received we will contact you by email or telephone.
Earth de Fleur Homewares reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at its sole discretion.
Payment Methods and Processing
Earth de Fleur Homewares accepts PayPal, Money Order, Visa and MasterCard only.
Payment can also be made by direct deposit to our bank account. Orders paid for by direct deposit will not be processed until payment has been received. Please enter your order number in the transaction description.
Orders placed on a weekend or a public holiday will not begin payment processing until the next business day.
Business days are Monday through Friday, except Wednesdays we are closed, excluding Queensland public holidays.
We process credit card and PayPal payments after you click the "Submit My Order" button.
For credit card and PayPal payments we will email a tax invoice to you with your order confirmation. Your tax invoice is your proof of purchase.
Please Note:
We will not accept credit cards issued by banks outside of Australia. Our preference in this instance is direct debit or payment via PayPal.
Debit cards and cheque cards have daily spending limits that may substantially delay the processing of your order.
You may be required to provide further identification for additional security reference checks.
If your PayPal payment is funded by an e-cheque this may substantially delay processing your order while payment clears.
GST
All prices quoted on this website are inclusive of GST except for items that are exempt from GST. Items that include GST, and the total GST paid will be clearly marked on the invoice.
Prices
Earth de Fleur Homewares always seeks to list Products with the most competitive prices.
Earth de Fleur Homewares reserves the right to change prices for Products displayed on the Earth de Fleur Homewares website at any time.
Supply of Products
Subject to these Terms and Conditions, we will supply to you the Products indicated on your order confirmation.
When your order items have been despatched, we will email you to confirm shipment of each item.
Care of Products ~ Metal Items
Metal Items - Some items are constructed with metal (steel) and tin. These items
are not protected with anti-rust treatment and if left unprotected will be subject to the
natural forces which produce rust.
Earth de Fleur Homewares does not give warranty against rusting or natural corrosion on any metal item.
Rusting of metal is a normal process and the time taken for natural rust to form
on the item will depend on the position, proximity to water and wind, and how
the item is treated. We recommend coating your item with a clear lacquer or Rustguard to protect your item, please contact your local hardware store.
Hand Made Variances
Most items are individually hand made. For this reason there may be some natural variances and slight imperfections between each piece. This is the beauty of a handmade product.
Colour
Every effort is made to ensure that the colour is consistent between each piece. However it is expected to have slight colour variances from piece to piece due to handmade items. We ensure high quality and try to meet high expectations.
Computer monitors have different colour gradients and might look different to the actual product and will differ from monitor to monitor.
Refund & Return Policy
If you find that the goods were damaged in transit or were faulty in some manner; please contact sales@earthhomewares.com.au within 24 hours of receiving the goods. We will organise for the return of the goods, a replacement, exchange or arrange a credit towards your next purchase. It is recommended that when your goods are delivered, that you check the contents before signing for them.
You may return any item by mail with 7 days of receipt of the product. Please contact sales@earthhomewares.com.au to request a Return Form.

WA, NT, TAS - $14.95 Standard Delivery or $24.95 Express Post
Custom or bulk orders are subject to normal shipping rates which will be quoted on your Invoice.

Delivery Schedule
All orders are despatched within 24 hours of being received Monday to Friday. Except no orders are despatched Wednesdays (we are closed on Wednesdays). If you have an urgent delivery call 0401 224 310 to notify us. All orders received over the weekend are despatched Monday.
Delivery from Brisbane to other cities and large towns in QLD: 1-3 working days
Delivery between other locations within QLD: 1-3 working days
Delivery between Brisbane and adjoining east coast capitals (including Adelaide): 2 working days
Delivery from Brisbane to other capital cities: 3-5 working days
Delivery from Brisbane to other interstate locations: 4-6 working days
World-wide
We do ship World-wide to selected countries only. Please contact us and advise your Address and product quantities. We will provide you with a shipping quote.
All invoices and payments are made through Paypal.
Title and risk of loss to all products will pass to you on delivery.

Under the Trade Practices Act 1974 ("Act"), where implied conditions and warranties cannot be excluded, any liability in Earth de Fleur Homewares for breach of such conditions and warranties (other than a condition or warranty implied by section 69 of the Act) shall be limited, at the option Earth De’fleur Homewares, to the replacement of the Product(s) or the re-supply of the same Product(s); the payment of the cost of replacing the Product(s) or of acquiring equivalent Product(s).
Neither our failure nor your failure to enforce any Term or Condition constitutes a waiver of such Term or Condition. Such failure shall in no way affect the right to later enforce such Term or Condition.
Earth de Fleur Homewares reserves the right to change the Terms and Conditions of sale at any time.
No Earth de Fleur Homewares employee or agent has the authority to vary any of the Terms and Conditions governing any sale.
Force Majeure
Earth de Fleur Homewares shall not be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of Earth de Fleur Homewares, and Earth de Fleur Homewares shall be entitled to a reasonable extension of time for the performance of such obligations.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Queensland and shall be subject to the non-exclusive jurisdiction of the courts of Queensland.
